Major Progress in Robodebt Reforms
The Albanese Government has made substantial progress in implementing reforms following the unlawful Robodebt Scheme, with its response to the Royal Commission report released on 13 November 2023. In less than a year, the government has fully implemented 28 of the Royal Commission’s recommendations.
Background and Findings
The final report, spanning three volumes and nearly 1,000 pages, contained 57 recommendations for improved public policy design. The investigation concluded that the robodebt scheme was “devised without regard to the social security law” and that the income averaging method was fundamentally unfair.
Current Implementation Measures
Key reforms include the introduction of the Oversight Legislation Amendment Bill 2024 and the establishment of the new Administrative Review Tribunal (ART) on 14 October 2024. The Tribunal ensures greater transparency by requiring members to report system issues in administrative decision-making and publishing significant decisions.
Within the government and public service, processes have been enhanced to ensure proper identification of legal risks and provision of legality advice to Ministers and decision-makers. The government has also committed to establishing an Integrity Strategy for the Australian Public Service and improving transparency in automated decision-making.
Focus on Vulnerable Australians
The government’s reform agenda aims to rebuild trust in government institutions while putting Australians at the centre of policy and services. This includes implementing better safeguards for vulnerable people interacting with Services Australia and streamlining processes to prioritise people in service and policy design.
Looking Forward
The Government is on track to have fully implemented the majority of the Royal Commission’s recommendations by the end of the year, with a further implementation update scheduled for early 2025.
